Caution is one of the orienting principles of neuroscience’s advance in different social spheres. This article shows the importance of maintaining caution in the area of neurolaw because of its risk of becoming a new power that is free from ethical discussion. The article’s objective is to note the principal ethical implications and limitations of neurolaw in light of six cases in which neuroscientific evidence was used in distinct ways. La autonomía constituye uno de los pilares básicos de un sistema político como el democrático que se asocia a la capacidad de toma de decisiones de la ciudadanía como su núcleo moral principal. Los descubrimientos en el ámbito de las neurociencias y su aplicación al campo del marketing y a la comunicación política despiertan hoy en día las sospechas por la posible capacidad de activar el "botón del voto" de los electores. Este artículo tiene como objetivo adentrarse en el estudio (...) de los principales trabajos desarrollados sobre el neuromarketing político y la neuropolítica. La finalidad de esta propuesta consiste en presentar los debates éticos que irrumpen con el neuromarketing político. Autonomy is one of the basic pillars of a political system like democracy, which is associated with citizens’ decision-making capacity as its main moral core. Discoveries in the neurosciences domain and their application to the marketing and political communication field now arouse suspicions about the possible capacity of activating voter’s "voting button". The objective of this article is to examine the main works on political neuromarketing and neuropolitics. Los índices bibliométricos están adentrándose de manera progresiva en la realidad de la comunidad académica. Por un lado, conceptos como ranking de publicaciones y cuartiles se emplean en procesos de valoración como las acreditaciones, los sexenios o la concesión de proyectos. Por otro lado, las grandes editoriales están consolidando modelos de difusión de la información que dificultan su acceso para la comunidad investigadora. El objetivo de este artículo consiste en examinar críticamente la combinación que se produce entre la bibliometría, los (...) sistemas imperantes de valoración de la investigación y los modelos editoriales. Este análisis nos lleva a esbozar algunos retos éticos que se plantea para el área de filosofía moral. Bibliometric indices are progressively moving towards the reality of the academic community. On the one hand, concepts like rankings of publications and quartiles are used in evaluation processes, such as accreditations, sexennials or awarding projects. On the other hand, large publishing houses consolidate models to diffuse information which makes the access difficult for the research community. This article aims to critically examine the combination formed by bibliometry, prevailing systems that evaluate research and publishing models. This analysis allowed us to outline some ethical challenges that are considered for the moral philosophy area at different levels. (shrink)

Empirical studies have revealed a disturbing prevalence of research misconduct in a wide variety of disciplines, although not, to date, in the areas of ethics and philosophy. This study aims to provide empirical evidence on perceptions of how serious a problem research misconduct is in these two disciplines in Spain, particularly regarding the effects that the model used to evaluate academics’ research performance may have on their ethical behaviour. The methodological triangulation applied in the study combines a questionnaire, a debate (...) at the annual meeting of scientific association, and in-depth interviews. Of the 541 questionnaires sent out, 201 responses were obtained, with a significant difference in the participation of researchers in philosophy and in ethics ; 26 researchers took part in the debate and 14 interviews were conducted. The questionnaire results reveal that 91.5% of the respondents considered research misconduct to be on the rise; 63.2% considered at least three of the fraudulent practices referred to in the study to be commonplace, and 84.1% identified two or more such practices. The researchers perceived a high prevalence of duplicate publication and self-plagiarism, use of personal influence and citation manipulation, in contrast to a low perceived incidence of data falsification or fabrication. The debate and the interviews corroborated these data. Researchers associated the spread of these misconducts with the research evaluation model applied in Spain. (shrink)

Si no me falla la memoria, fue el dibujante Álvaro Barrios quien afirmó que el trabajo del artista contemporáneo colombiano se desarrolla según una agenda de trabajo. Si miramos algunos fenómenos del arte último en Colombia, podemos señalar que su agenda está determinada por el intento de comprensión de los procesos de la violencia en el país, a partir de una amplia gama de aproximaciones al concepto de memoria que ha tenido resonancia en las disciplinas humanísticas, las investigaciones académicas, el (...) uso político del concepto por parte de la legislación estatal, y una gran diversidad de eventos artísticos. Desde el ámbito del arte, exposiciones como Destierro y reparación (2008), Tapices de Mampuján (2010), La guerra que no hemos visto (2009) o La piel de la memoria (2011), han discutido sobre la violencia en Colombia desde la aproximación a los procesos de comprensión de la memoria y nuestro pasado reciente. Así, la imbricación de violencia y memoria se manifiesta en la visión del pasado y en los efectos que este puede desplegar sobre el presente, en tanto se ha considerado, incluso, a la memoria como una instancia de reconciliación social. Developed by Arthur Prior, Temporal Logic allows to represent temporal information on a logical system using modal operators such as P, F, H or G, whose intuitive meaning is “it was sometime in the Past...”, “it will be sometime in the Future...”, “it Has always been in the past...” and “it will always Going to be in the future...” respectively. Valuation of formulae built from these operators are carried out on Kripke semantics, so Modal Logic and Temporal Logic are consequently (...) related. In fact, Temporal Logic is an extension of Modal one. Even when both logics mechanisms are able to formalize modal-temporal information with some accuracy, they suffer from a lack of expressiveness which Hybrid Logic can solve. Indeed, one of the problems of Modal Logic consists in its incapacity of naming specific points inside a model. As Temporal Logic is based on it, it cannot make such a thing neither. But First-Order Logic does can by means of constants and equality relation. Hybrid Logic, which results from combining Modal Logic and First-Order Logic, may solve this shortcoming. The main aim of this paper is to explain how Hybrid Logic emanates from Modal and Temporal ones in order to show what it adds to both logics with regard to information representation, why it is more expressive than them and what relation it maintains with the First-Order Correspondence Language. The old aphorism saying “no pic, no news” is still very alive, although the immediacy of social networks has modified this in a way: the truth is that a set of factors has conspired to cloud the communicative landscape on networks, so what was once considered reliable proof of fact – a photo – cannot be taken as such, without the assistance of experts whose criteria cannot be easily understood by the public. Turning into a matter of discussion and opinion (...) what would otherwise be incontrovertible facts. Fabricating facts has never been so convincingly available to so many. (shrink)

This study analyzes the interests of Spanish audiences in travel magazines within the current context of press consumption. The objectives are to identify the readers' reading frequency and reasons for reading, what contents interest them, and what aspects of the photographs attract them. The methodology involves a structured questionnaire completed by a representative sample of the Spanish population (n=1000). The main results reveal a low reading frequency, great interest in practical information, preference for landscape photography (over the age of 54) (...) and nightlife photography (young people), and indifference regarding the journalistic source of the images. These data provide relevant information on which to adapt travel magazines' content strategy. (shrink)

Background: Heart rate variability (HRV) has been considered as a measure of heart-brain interaction and autonomic modulation, and it is modified by cognitive and attentional tasks. In cognitive tasks, HRV was reduced in participants who achieved worse results. This could indicate the possibility of HRV predicting cognitive performance, but this association is still unclear in a high cognitive load sport such as chess Objective: To analyse modifications on HRV and subjective perception of stress, difficulty and complexity in different chess problem (...) tasks. Design: HRV was assessed at baseline. During the chess problems, HRV was also monitored, and immediately after chess problems the subjective stress, difficulty and complexity were also registered. Method: A total of 16 male chess players, age: 35.19 (13.44) and ELO: 1927.69 (167.78) were analysed while six chess problem solving tasks with different level of difficulty were conducted (two low level, two medium level and two high level chess problems). Participants were classified according to their results into two groups: high performance or low performance. Results: Friedman test showed a significant effect of tasks in HRV indexes and perceived difficulty, stress and complexity in both high and low performance groups. A decrease in HRV was observed in both groups when chess problems difficulty increased. In addition, HRV was significantly higher in the high performance group than in the low performance group during chess problems. Conclusions: An increase in autonomic modulation was observed to meet the cognitive demands of the problems, being higher while the difficulty of the tasks increased. Non-linear HRV indexes seem to be more reactive to tasks difficulty, being an interesting and useful tool in chess training. (shrink)

We aimed to conduct a scoping review to assess the profile of retracted health sciences articles authored by individuals affiliated with academic institutions in Latin America and the Caribbean (LAC). We systematically searched seven databases (PubMed, Scopus, Web of Science, Embase, Medline/Ovid, Scielo, and LILACS). We included articles published in peer‐reviewed journals between 2003 and 2022 that had at least one author with an institutional affiliation in LAC. Data were collected on the year of publication, study design, authors' countries of (...) origin, number of authors, subject matter of the manuscript, scientific journals of publication, retraction characteristics, and reasons for retraction. We included 147 articles, the majority being observational studies (41.5%). The LAC countries with the highest number of retractions were Brazil (n = 69), Colombia (n = 16), and Mexico (n = 15). The areas of study with the highest number of retractions were infectology (n = 21) and basic sciences (n = 15). A retraction label was applied to 89.1% of the articles, 70.7% were retracted by journal editors, and 89.1% followed international retraction guidelines. The primary reasons for retraction included errors in procedures or data collection (n = 39), inconsistency in results or conclusions (n = 37), plagiarism (n = 21), and suspected scientific fraud (n = 19). In conclusion, most retractions of scientific publications in health sciences in LAC adhered to international guidelines and were linked to methodological issues in execution and scientific misconduct. Efforts should be directed toward ensuring the integrity of scientific research in the field of health. (shrink)

El Cratilo, verdadera primicia de la filosofía del lenguaje, es una de las obras más difíciles salidas de la pluma de Platón. De un lado, en él se esbozan ideas de gramática y semiótica –semántica, sintáctica y pragmática–, se analiza el lenguaje griego real y se esboza un lenguaje ideal; del otro, está tachado por la enorme dificultad que le imprimen el tono irónico de Sócrates y el anonimato de sus interlocutores, la larga y misteriosa lista de etimologías y la (...) dinámica dialéctica del discurso. Ese poder de sugestión y repulsión, signo inequívoco de todas las grandes obras, explica que filósofos y filólogos de todos los tiempos le sean deudores, desde Aristóteles y Dionisio el Tracio hasta Saussure y Gadamer. Su distinción entre rectitud natural y convencional de los nombres marcó un hito insuperable en la teoría de los signos; sus ideas sobre el cuerpo humano como signo viviente y primordial, sobre la pintura y la música como paradigma del lenguaje escrito y oral, sobre el signo perfecto, «doble» o biunívoco, como signo realmente inútil, encierran virtualidades todavía sin explotar. La edición del profesor Atilano Domínguez ofrece una serie de instrumentos de gran utilidad tanto para el lector general como para el estudioso. Unos son de carácter general: la extensa y documentada introducción, las notas al texto platónico, el índice analítico, y una bibliografía que contiene las principales ediciones y traducciones del Cratilo, así como el listado alfabético casi completo de cuantos estudios se le han dedicado. A esos instrumentos generales, se añaden otros específicos que intentan responder al carácter propio de la obra: la introducción de nuevos párrafos, la estructuración sistemática del texto platónico, con sus epígrafes también entre corchetes, el índice, en caracteres griegos, de las doscientas etimologías recensionadas en esta obra, con sus diversas acepciones. Además, se han incorporado al índice analítico, en caracteres latinos, los términos griegos que corresponden a los castellanos. (shrink)

This paper explores how João de Andrade Corvo and José Vicente Barbosa du Bocage, two nineteenth-century Portuguese naturalists, were able to reach prominent political positions in their country by means of their work in, respectively, botany and agriculture, and zoology. The authority they derived from their scientific activities and the knowledge they acquired in the process, favored by their proximity to particular political quarters, elevated them to important governmental offices, in the context of which they implemented policies that reinforced (...) Portugal’s identity as an imperial nation. The colonial policies and agreements signed by Corvo and Bocage aimed at securing Portuguese colonial territories, which, aside from their economic relevance, constituted a symbol of power that reinforced the sovereignty of a small nation in a Europe dominated by the rule of increasingly vaster and stronger states. In spite of their different scientific careers and personal interests, both naturalists played key roles in Portuguese foreign affairs and colonial negotiations of the late nineteenth century, especially during the Scramble for Africa. Historical studies on the relationship between science and diplomacy tend to focus on events since World War II and on initiatives for the maintenance of peace or to achieve cooperation over contentious matters. This article presents the case of José Vicente Barbosa du Bocage (1823–1907), a Portuguese zoologist who had formal diplomatic responsibilities in a context of competition for the colonization of Africa in the nineteenth century. He used his knowledge in African geography to implement colonial and diplomatic strategies (...) that aimed at outcompeting rival powers. The development of a network of actors with scientific, colonial, and diplomatic expertise was crucial for the negotiations that involved the partition of the Congo basin, which resulted in victories for Portugal that surpassed the country's marginal political relevance at the international level and had long‐lasting consequences. This paper discusses the life and scientific work of José Vicente Barbosa du Bocage, a nineteenth-century Portuguese naturalist who carved a new place for zoological research in Portugal and built up a prestigious scientific career by securing appropriate physical and institutional spaces to the discipline. Although he was appointed professor of zoology at the Lisbon Polytechnic School, an institution mainly devoted to the preparatory training of military officers and engineers, he succeeded in creating the conditions that allowed him to (...) develop consistent research in zoology at this institution. Taking advantage of the reconstruction and further improvement of the building of the Lisbon Polytechnic, following a violent fire in 1843, Bocage transferred a natural history museum formerly located at the Academy of Sciences of Lisbon to his institution, where he conquered a more prestigious place for zoology. Although successive governments were unwilling to meet Bocage’s ambitions for the Zoological Section of the newly created National Museum of Lisbon, the collaborators he found in different parts of the Portuguese continental territory and colonial empire supplied him the specimens he needed to make a career as a naturalist. Bocage ultimately became a renowned specialist in Southwestern African fauna thanks to José de Anchieta, his finest collaborator. Travels to foreign museums, and the establishment of links with the international community of zoologists, proved fundamental to build up Bocage’s national and international scientific reputation, as it will be exemplified by the discussion of his discovery of Hyalonema, a specimen with a controversial identity collected off the Portuguese coast. The aim of this paper is to describe and defend the moving spotlight theory of time. I characterise the moving spotlight theory as the conjunction of two theses: permanentism, the thesis that everything exists forever, and the A-theory, the thesis that there is an absolute, objective present time. I begin in Sect. 2 by clearing up some common misconceptions about the moving spotlight theory, focusing on the discussion of the theory in Sider. In doing so, I also fill-out the barebones (...) picture of the moving spotlight theory as the conjunction of permanentism and the A-theory. In Sect. 3 I show how moving spotlighters can avoid the two common objections to their view, the McTaggartian argument that the view is contradictory, and the epistemic argument that the view implies that we should believe we are not located at the present moment. I conclude that the moving spotlight theory does not deserve its current relative unpopularity. (shrink)

A partir de análise da argumentação habermasiana realizada em sua obra “Conhecimento e Interesse” original de 1968, a qual trabalhamos a partir da tradução de 1987; e ancorados nos trabalhos dos filósofos brasileiros Durão, publicado em seu livro “A crítica de Habermas à dedução transcendental de Kant” de 1996 e Hansen, em seu artigo publicado na Revista Crítica, intitulado “Os riscos da crítica da sociedade” de 1998, refletimos, nesse artigo, sobre como Habermas resgata a Teoria do Conhecimento da maneira desvirtuada (...) que a legou o positivismo comteano, perpassando por Freud e Marx para recuperá-la como uma Teoria Crítica da Sociedade. E, apresentamos o advento da Era da Informação e as facilidades de comunicação que a acompanham, para apresentar o modelo da Educação à Distância como uma forma eficaz de ampliar o alcance da Crítica Social como autorreflexão que torna o conhecimento um instrumento crítico não só do indivíduo, mas também da sociedade. Hamas’s deliberate attack on October 7th against innocent civilians is absolutely wrong. Therefore, it should be universally condemned. And yet, I wonder how a universal recognition of an absolute duty of respect for human dignity can help solving the existential conflict confronting Israelis and Palestinians. Ideally, a two-state solution proposed by the international community can be seen as a reasonable and fair compromise. Nevertheless, the reality on the ground is different. Thus far the existence of one state has precluded the (...) existence of another with no end in sight to their mutually destructive violence. Their conflict demands that people who are reasonable and fair-minded try to understand it holistically and to offer an impartial assessment of this intractable conflict without relativizing the undeserved human suffering of all those involved and affected by it. El ataque deliberado de Hamás el 7 de octubre contra civiles inocentes es absolutamente inicuo. Por lo tanto, debe ser condenado universalmente. Y, sin embargo, me pregunto cómo un reconocimiento universal de un deber absoluto de respeto por la dignidad humana puede ayudar a resolver el conflicto existencial al que se enfrentan israelíes y palestinos. Idealmente, una solución de dos Estados propuesta por la comunidad internacional puede ser vista como un compromiso razonable y justo. Sin embargo, la realidad sobre el (...) terreno es diferente. Hasta ahora, la existencia de un Estado ha impedido la existencia de otro, sin que se vislumbre el final de su violencia mutuamente destructiva. Su conflicto exige que las personas razonables e imparciales traten de entenderlo de manera holística y de ofrecer una evaluación justa de este conflicto insoluble sin relativizar el sufrimiento humano inmerecido de todos los involucrados y afectados por él. In this study Daniel Conway shows how Nietzsche's political thinking bears a closer resemblance to the conservative republicanism of his predecessors than to the progressive liberalism of his contemporaries. The key contemporary figures such as Habermas, Foucault, McIntyre, Rorty and Rawls are also examined in the light of Nietzsche's political legacy. _Nietzsche and the Political___ also draws out important implications for contemporary liberalism and feminist thought, above all showing Nietzsche's continuing relevance to the shape of political thinking today.

The polemic was an important cultural event in 19th-century Cuba. From 1838 to 1840, issues of metaphysics, epistemology, ethics, pedagogy, and the influence of Victor Cousin’s eclecticism were discussed in the island’s leading newspapers. A brief historical account preceding the polemic is offered. It is argued that the predominant view of the polemic as motivated by a widespread desire for Cuba’s independence from Spain is misleading — promoting an emancipatory myth. Lastly, it is argued that José de la Luz y (...) Caballero’s appeal to patriotism during the polemic unwittingly established a dangerous precedent for self-appointed guardians of patriotism to condition public debates. (shrink)

Let us begin with what all of us here agree on: folk psychology is not immune to revision. It has a certain vulnerability in principle. Any particular part of it might be overthrown and replaced by some other doctrine. Yet we disagree about how likely it is that that vulnerability in principle will turn into the actual demise of large portions--or all--of folk psychology. I am of the view that folk psychology is here for the long haul, and for some (...) very good reasons. But I am not going to concentrate on that in my remarks. What nobody has bothered saying here yet, but is probably worth saying, is that for all of its blemishes, warts and perplexities, folk psychology is an extraordinarily powerful source of prediction. It is not just prodigiously powerful but remarkably easy for human beings to use. We are virtuoso exploiters of not so much a theory as a craft. That is, we might better call it a folk craft rather than a folk theory. The theory of folk psychology is the ideology about the craft, and there is lots of room, as anthropologists will remind us, for false ideology. (shrink)

I offer a hopefully compelling defense of the view of those whom I refer to as hard-core opponents of terrorism. For hard-core opponents, terrorism is categorically wrong and, therefore, morally and legally unjustified. I view terrorism as either equivalent to murder or man slaughter in domestic law, or equivalent to crimes against humanity or war crimes in international law. If my argument is compelling, at least two important results follow from it. First, that under no circumstances is terrorism justified. And (...) second, that even if my argument were to be compelling, it will not necessarily end debates about the nature, justification, or excuse of terrorism. (shrink)

In this piece of work we considerer mathematical logic as a whole. The three steps distinguished by Husserl, to wit, pure logic grammar, logic of the non-contradiction and logic of the truth, are analysed. They are applied to the logistics by distinguishing different levels and layers. In each level the logistics methods and its correspondence with the formal ontology inside the philosophical phenomenology are taken into account. The subject is completed explaining the axiomatic as well as the Greek life in (...) Euclides and in comparison with Hilbert. Finally, we intend to interpret the Greek logic, Leibniz logic and logistics from the viewpoint of different types of life related to them. In all these cases we presuppose, as a source, the apofantic aristotelian form of the proposition. (shrink)

Hybrid metaethical theories attempt to incorporate essential elements of expressivism and cognitivism, and thereby to accrue the benefits of both. Hybrid theories are often defended in part by appeals to slurs and other pejoratives, which have both expressive and cognitivist features. This paper takes far more seriously the analogy between pejoratives and moral predicates. It explains how pejoratives work, identifies the features that allow pejoratives to do that work, and models a theory of moral predicates on those features. The result (...) is an expressivist theory that, among other advantages, is immune to embedding difficulties and avoids an overlooked difficulty concerning attitude ascriptions that is lethal to most other hybrid theories. El artículo consta de cuatro partes. En la primera parte, la introducción, señalo algunos aspectos de la importancia del proyecto. Segundo, describo y evalúo como Varela interpreta la filosofía. Tercero, exploro su eclecticismo dentro de su filosofía. Por último, explico el concepto de utilidad en el quehacer filosófico de Varela. Estos tres conceptos: filosofía, eclecticismo y utilidad están correlacionados en su obra. La filosofía con la recta razón. El eclecticismo, o lo que Varela llama la “verdadera filosofía,” con la sabia (...) selección de argumentos, incluyendo diversos métodos para explorar nuestras experiencias cotidianas, y la utilidad con la mesurada evaluación de nuestra conducta, incluyendo el bien común. Dado que estos tres conceptos son polisémicos, ellos pueden ser manipulados, y de hecho han sido tergiversados, por pensadores que han tratado de explicar el pensamiento filosófico vareliano con fines partidistas, ya sea con buenas intenciones o con fines ideológicos tendenciosos. Background: COVID-19 has taken many lives worldwide and due to this, millions of persons are in grief. When the grief process lasts longer than 6 months, the person is in risk of developing Complicated Grief Disorder. The CGD is related to serious health consequences. To reduce the probability of developing CGD a preventive intervention could be applied. In developing countries like Mexico, the psychological services are scarce, self-applied interventions could provide support to solve this problem and reduce the health impact (...) even after the pandemic has already finished.Aims: To design and implement a self-applied intervention composed of 12 modules focused on the decrease of the risk of developing CGD, and increasing the life quality, and as a secondary objective to reduce the symptomatology of anxiety, depression, and increase of sleep quality. The Intervention Duelo COVID follows the principles of User Experience and is designed according to the needs and desires of a sample of the objective participants, to increase the adherence to the self-applied intervention, considered one of the main weaknesses of online interventions.Methods: A Randomized Controlled Trial will be conducted from the 22nd of December of 2020 to the first of June 2021. The participants will be assigned to an intervention with elements of Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Mindfulness and Positive Psychology. The control group will be a wait-list condition, that will receive the intervention 1.5–2 months after the pre-measurement were taken. The Power Size Calculation conducted through G*Power indicated the need for a total of 42 participants, which will be divided by 21 participants in each group. The platform will be delivered through responsive design assuring with this that the intervention will adapt to the screen size of cellphones, tablets, and computers.Ethics and Dissemination: The study counts with the approval of the Research Ethics Committee of the Autonomous University of Ciudad Juárez, México, and it is registered in Clinical Trials. The article is sent and registered in clinical trials before the recruitment started. The results will be reported in future conferences, scientific publications, and media. (shrink)

This chapter explores the debate between contemporary projectivists or expressivists, and the advocates of sensibility theory. Both positions are best viewed as forms of sentimentalism — the theory that evaluative concepts must be explicated by appeal to the sentiments. It argues that the sophisticated interpretation of such notions as “true” and “objective” that are offered by defenders of these competing views ultimately undermines the significance of their meta-ethical disputes over “cognitivism” and “realism” about value. Hybrid metaethical theories attempt to incorporate essential elements of expressivism and cognitivism, and thereby to accrue the benefits of both. Hybrid theories are often defended in part by appeals to slurs and other pejoratives, which have both expressive and cognitivist features. This paper takes far more seriously the analogy between pejoratives and moral predicates. It explains how pejoratives work, identifies the features that allow pejoratives to do that work, and models a theory of moral predicates on those features. The result (...) is an expressivist theory that, among other advantages, is immune to embedding difficulties and avoids an overlooked difficulty concerning attitude ascriptions that is lethal to most other hybrid theories. In this article, it is argued that a significant internal tension exists in John Rawls' political liberalism. He holds the following positions that might plausibly be considered incongruous: (1) a commitment to tolerating a broad right of freedom of political speech, including a right of subversive advocacy; (2) a commitment to restricting this broad right if it is intended to incite and likely to bring about imminent violence; and (3) a commitment to curbing this broad right only if there is (...) a constitutional crisis. By supporting a broad right of freedom of political speech in Political Liberalism, he allows militant intolerant people such as Jihadists, White Supremacists and Neo-Nazis to advocate publicly their dangerously intolerant beliefs. Public advocacy of dangerously intolerant beliefs can be construed as subversive advocacy. As demonstrated by the historical examples of the Weimar Republic and the Second Spanish Republic, militant intolerant groups could use a right of subversive advocacy to threaten the stability of liberal democracies. Hence, by allowing them to exercise a broad right of freedom of political speech, Rawls could jeopardize that which he intends to defend, namely the actual political stability of a liberal democratic order. Lastly, Rawls' conception of ideal constitutional interpretation, which privileges a broad right of freedom of political speech, might be insufficient to deal effectively with the threat posed by militant intolerant groups. Yet a tradition of American constitutional interpretation that balances freedom of speech with other important constitutional and/or political values has overcome a civil war, two world wars, the Cold War and the 9/11 terrorist attacks without abandoning democracy or permanently renouncing those values. Still, Rawls' ideal approach to constitutional interpretation might, in hindsight, help us to understand some of the excesses and deficiencies of American jurisprudence in times of emergency.<br><br><br><br>.
